5. Property Information; No Real Estate or Investment Advice

All properties are subject to prior sale, change, withdrawal, or errors without notice. Better Path Homes is not your real estate agent, broker, attorney, accountant, lender, or financial advisor unless we expressly agree to such a role in a separate written agreement. You are solely responsible for conducting your own due diligence and for consulting your own qualified professionals before making any investment or real estate decision.

6. Intellectual Property

The Services and all content, software, logos, trademarks, designs, and other materials included in the Services (collectively, the "Content") are owned by Better Path Homes or its licensors and are protected by intellectual property laws. You are solely responsible for any information, materials, or other content you submit, upload, or make available through the Services ("User Content"). By submitting User Content, you grant Better Path Homes a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, use, reproduce, modify, and display the User Content as necessary to operate and improve the Services. You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate any law or third-party right.

THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY PROPERTY INFORMATION, VALUATIONS, OR OTHER CONTENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BETTER PATH HOMES, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES OR ANY CONTENT, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNTS YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

10. Indemnification

You agree to indemnify, defend, and hold harmless Better Path Homes, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

The Services may contain links to or interoperate with third-party websites, services, or content. We do not control and are not responsible for any third-party services, and your use of them is at your own risk and subject to their applicable terms.

12. Termination

We may suspend or terminate your access to all or any part of the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, disclaimers, indemnities, and limitations of liability.

13. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Services will be governed by the laws of the State in which Better Path Homes maintains its principal place of business, without regard to its conflict-of-law principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in that jurisdiction, and you consent to the personal jurisdiction and venue of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will revise the "Last updated" date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.

15. Miscellaneous

These Terms, together with our Privacy Policy and any other terms or policies we expressly reference, constitute the entire agreement between you and Better Path Homes regarding the Services and supersede all prior or contemporaneous understandings. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction.
